These Terms of Use ("Terms") govern your access to and use of the Vandeni website at https://vandeni.com ("the Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.

2. About us

Vandeni ("we", "us", "our") is a software development company providing web development, mobile app development, custom software development, digital transformation, and business process automation services. The Site introduces these services and lets you contact us and book calls. Specific terms for any project or paid engagement will be set out separately in the applicable proposal and engagement agreement, which take precedence over these Terms.

3. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• use the Site in any way that violates applicable law;
• attempt to gain unauthorized access to the Site, its servers, or connected systems, or otherwise interfere with the Site's operation;
• introduce or transmit any viruses, malware, or other harmful code;
• submit false, misleading, or unlawful information through our contact form or booking tools;
• scrape, copy, or systematically extract content from the Site beyond reasonable personal use; or
• use the Site to harass, defame, or harm any person or entity.

4. Accuracy of information

We work to keep the information on the Site (including service descriptions, case studies, and blog content) accurate and up-to-date, but we do not guarantee that all content is error-free, complete, or current. Case studies and examples are provided for illustration and individual results may vary.

5. Intellectual property

Unless otherwise stated, the Site and all of its content — including text, graphics, logos, code, designs, and software — are owned by Vandeni or its licensors and are protected by intellectual property laws. You may view and print content for personal, non-commercial use, but you may not copy, reproduce, modify, distribute, or republish it for any commercial purpose without our prior written consent.

Nothing in these Terms transfers ownership of any intellectual property. Deliverables created for a client under a separate engagement agreement are governed by the terms of that agreement.

6. Submitting information to us

When you contact us through the Site, you confirm that the information you provide is accurate and complete. Please do not send confidential or proprietary information through the contact form unless we have entered into a non-disclosure agreement with you; unsolicited submissions are treated as non-confidential. Information you submit is handled in accordance with our Privacy Policy.

7. Third-party links and services

The Site may link to third-party websites and services, including Cal.com for call bookings and Google services for analytics and bot detection. These links are provided for your convenience. We do not control these third parties and are not responsible for their content, practices, or privacy policies. Your use of third-party services is subject to their own terms and policies.

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 9. Limitation of liability

To the maximum extent permitted by law, Vandeni shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Site. Our total liability to you for all claims arising from your use of the Site shall not exceed the amount you paid us (if any) in connection with the Site in the twelve months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud, death, or personal injury caused by negligence.

10. Indemnification

You agree to indemnify and hold harmless Vandeni and its team members from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Site or your breach of these Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Vandeni is registered, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, except where mandatory consumer protection laws in your country of residence require otherwise.

We may revise these Terms from time to time. The current version will always be published on this page, with the "Last updated" date shown above. Continued use of the Site after changes are published constitutes acceptance of the revised Terms.
